Freedom of Information Act 2000

The Freedom of Information (FOI) Act 2000 gives a general right of access to all types of non-personal (corporate and business) information held by the Trust (a Public Authority).

The Right to Information

Individuals already have the right to access information about them ('Personal data'), which is held on computer, and in some paper files, under the Data Protection Act 2018. This is known as the 'Subject Access Right'.

Requesting Information

You will not be required to mention either the FOI Act or give a reason for your request when making a request for information.

Before the Trust is required to respond, a request will have to satisfy certain conditions:

• In a permanent form.

• State the name of the applicant, address for correspondence.

• Include sufficient information to enable the Trust to identify the information requested.

Raise a Freedom of Information (FOI) request for information. 

Please note, this form is not to be used to request medical records from North Bristol NHS Trust. If you would like to request medical records and have a legal right of access as a patient, parent, personal representative, solicitor, police, mental capacity advocate etc., please complete our online Subject Access Request form. 

'Fees Regulations'

The Trust does not have to action the request for information if it estimates that the cost of complying will exceed the limit of £450.00.

• A national rate of £25.00 per person, per hour
• Photocopying at 25p per sheet
• Postage & packaging

FOI Publication Scheme

The Publication Scheme includes Freedom of Information requests made to us.

We shall review the Scheme at regular intervals and monitor how it is operating.

Under Section 19 of the Freedom of Information Act 2000, we have a duty to adopt and maintain a Publication Scheme. The purpose of the Act is to promote greater openness by public authorities. The Freedom of Information Act does not change the right of patients to protection of their confidentiality. Maintaining the legal right to patient confidentiality continues to be an important commitment on our part.

Reuse of Public Sector Information & Links with FOI

1 July 2005 new regulations came into force covering the re-use of public sector information (Re-use of Public Sector Information Regulations 2005 (SI 2005 No. 1515)

Responding to an FOI request by supplying information does not confer an automatic right of re-use.
